CLEAN AND GREEN CHALLENGE

OFFICIAL RULES



NO PURCHASE NECESSARY TO PARTICIPATE. VOID WHERE PROHIBITED. VALID IN THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA ONLY. INITIAL AND CONTINUED PARTICIPATION IN THIS CHALLENGE CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES.

The Clean and Green Challenge is designed to encourage registration and participation of Ft. Worth, TX residents in Recyclebank’s Reward Program (the “Challenge”) offered independent of or through Recyclebank’s corporate website, www.recyclebank.com (the “Site”). The Challenge begins at 12:01 a.m. EST on February 1, 2016 (the “Challenge Start Date”) and ends at 11:59 p.m. EST on May 31, 2016 (the “Challenge End Date”) (such period referred to herein as the “Challenge Period”). The Clean and Green Challenge is sponsored by Recyclebank, LLC (“Recyclebank”, or the “Sponsor”). Recyclebank will choose the winner of the Challenge and award the grand prize in accordance with these Official Rules (the “Rules”).

1. ELIGIBILITY:

Eligibility is limited to organizations within the greater Fort Worth, TX metropolitan area who actively promote resident participation in the City of Fort Worth’s recycling efforts and registration in Recyclebank’s incentive recycling program (the “Rewards Program”). By participating in the Challenge, each organization accepts the conditions stated in these Official Rules and agrees to be bound by the decision of the Sponsor. To participate in the Challenge, organizations will complete a participant information form to be reviewed by Recyclebank. All submissions are the sole property of Recyclebank and all participation determinations are in the sole and absolute discretion of Recyclebank. THE CHALLENGE IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW and is subject to all applicable federal, state and local laws and regulations. Participation is subject to the Sponsor’s Privacy Policy (http://www.recyclebank.com/about-us/privacy).

During the Challenge Period, Recyclebank will award participating organizations certain points associated with this Challenge as detailed in these Official Rules (“Challenge Points”) for purposes of determining the winner of this Challenge. Recyclebank will award Challenge Points based on the individual efforts of each participating organization to register eligible residents within Fort Worth, TX to the Rewards Program. All registrations are subject to Recyclebank’s sole and final determination and in accordance with Recyclebank’s Membership Agreement ((http://www.recyclebank.com/about-us/membership-agreement) and these Rules. The participating organization with the most Challenge Points by the Challenge End Date will receive the Grand Prize. If there is a tie between two or more participating organizations having an equal amount of Challenge Points by the Challenge End Date, Recyclebank will determine the winner by the total number of attendees at the events each participating organization among those tied hosted during the Challenge Period.

Recyclebank will award the following Challenge Points to participating organizations as part of the Challenge during the Challenge Period:

  • 100 Challenge Points for every 25 registered Members signed-up by completing a Rewards Program registration through the participating organization’s efforts (registration is completed through the participating organization’s dedicated URL provided by Recyclebank);
  • 200 Challenge Points for hosting a Recycling Awareness Event*. As part of this Recycling Awareness Event, the participating organization will receive 50 Challenge Points as a bonus for every 50 eligible residents who attend the event;
  • 300 Challenge Points for hosting an Earth Day 2016 Event*. As part of the Earth Day 2016 Event, the organization will receive 100 Challenge Points as a bonus for every 100 eligible residents who attend the event.


*Recyclebank staff member(s) or Fort Worth City staff member(s) may attend these events and provide support to the participating organizations where opportunity exists to do so.

The participating organization with the most Challenge Points earned in accordance with these Rules will be the winner of the Challenge. This Challenge is strictly limited to any and all Challenge Points earned during the Challenge Period as detailed in these Rules through the efforts of each participating organization using the dedicated URLs provided to each by Recyclebank to determine the origin of each registration.

2. CHALLENGE GRAND PRIZE:

Grand Prize (1):

$5,000

The one (1) Challenge winner having the most awarded Challenge Points during the Challenge Period will receive the Grand Prize listed above. The total approximate retail value of the Challenge Grand Prize is $5,000 (actual value may vary).

Additional potential prizes: $500 for any participating organization that reaches 500 Challenge Points

Any participating organization(s) having a total of 500 or more Challenge Points by the Challenge End Date will receive a prize in the amount of $500. The Grand Prize winner will not qualify for this additional potential prize. The total approximate retail value of each additional potential prize is $500 (actual value of total additional potential prizes may vary based on the number of participating organizations who qualify to receive this prize).

There is no substitution, cash equivalent or transfer of the prize allowed except where specified. The winner of the Challenge will be solely responsible for all other expenses not specifically set forth herein. Recyclebank reserves the right to substitute the prize of equal or greater value. No other substitution or transfer of prize permitted. Recyclebank is responsible only for prize delivery; not responsible for prize utility, quality or otherwise. In order to receive the prize, the winner of the Challenge may be required to provide proof of identification. Any and all taxes on any prize, including income and/or sales taxes, are the sole responsibility of the winner. However, Recyclebank may elect to cover all or a portion of such tax liability, in Recyclebank’s sole and absolute discretion.

3. SELECTION OF THE CHALLENGE WINNER:

Recyclebank will determine the winner of the Challenge at the conclusion of the Challenge Period. The winner will be notified by June 9, 2016.

The winner for the Challenge will be notified by e-mail using the information provided when the participating organization registered for participation in the Challenge with Recyclebank. Such notification shall include instructions for proper acceptance of the prize. In the event a winner does not accept a prize, a winner is ineligible, or the prize or prize notification is not deliverable, the participating organization with the second highest earned Reward Points during the Challenge Period will be selected as the winner of the Challenge and notified as described herein. The Sponsor is not responsible for and shall not be liable for late, lost, misdirected or unsuccessful efforts to notify a winner. The winner agrees to Sponsor’s use of its name, address, likeness, and/or prize information for promotional purposes in any medium without additional compensation to the extent permitted by law. Where lawful, the winners may be required to sign and return an Affidavit of Eligibility, Release of Liability, and Publicity Release (the “Release”). If the winner is a minor, the Release must be completed by the minor’s parent or legal guardian.

4. CONDITIONS:

The Sponsor, and its respective agents, directors, officers, shareholders, employees, insurers, servants, parents, subsidiaries, divisions, affiliates, predecessors, successors, representatives, advertising, promotion, and fulfillment agencies, and legal advisors (the “Released Entities”), are not responsible for, shall not be liable for, and hereby disclaim all liability arising from or relating to: (i) telephone, electronic, hardware or software program, network, Internet, computer or other malfunctions, failures, or difficulties of any kind, whether human or technical; (ii) failed, incomplete, garbled, or delayed computer or e-mail transmissions; (iii) any condition caused by events beyond the control of the Sponsor; (iv) any injuries, losses, or damages of any kind arising in connection with or as a result of any prize, or any portion thereof that may have been awarded, or acceptance, possession, or use of any prize, or any portion thereof that may have been awarded, or from participation in the Challenge; or (v) any printing or typographical errors in any materials associated with the Challenge. The Sponsor reserves the right, in its sole discretion, to suspend, modify or cancel the Challenge or any component of the Challenge should any unauthorized human intervention or other causes beyond the Sponsor’s control corrupt or affect the administration, security, fairness or proper conduct of the Challenge. In the event that proper administration of the Challenge is prevented by such causes as contemplated above, the Sponsor will determine the winner from all eligible, non-suspect earned Reward Points prior to such action. By participating in the Challenge, participants and the winner agree to release, discharge and hold harmless the Released Entities, and all others associated with the development and execution of the Challenge, from any and all losses, damages, rights, claims and actions of any kind arising out of or relating to the Challenge, participation in the Challenge, any prize, or any portion thereof that may have been awarded, and/or acceptance, possession, use or misuse of any prize, or any portion thereof that may have been awarded, including but not limited to statutory and common law claims for misappropriation or participant’s right of publicity. This Challenge shall be governed by New York law. By participating in this Challenge, participants agree that New York courts shall have jurisdiction over any dispute or litigation arising from or relating to this Challenge and that venue shall be only in New York, New York.

5. SUBMISSIONS:

Some of the designated Recyclebank points-based earn opportunities available by the Sponsor for the Challenge may offer you the opportunity to post or otherwise transmit comments, ideas or other information in any form, on or through the Site or authorized third party websites (collectively referred to herein as the “Submissions”). By posting or transmitting these Submissions you grant to Sponsor and its designees a worldwide, non-exclusive, sublicenseable, assignable, royalty-free, perpetual, irrevocable right (including moral rights) and license to use, reproduce, distribute, create derivative works based on, perform and/or display such Submissions (in whole or in part) in any media now known or hereafter developed, for any purpose whatsoever, without compensation to you or any other provider of the Submissions. You acknowledge that to the extent that you include personally identifiable information in your Submissions, we may republish such information.

6. THE CHALLENGE WINNERS LIST:

To obtain the organization’s name, city and state of the Clean and Green Challenge Winner following the Challenge End Date, send a separate self-addressed, stamped envelope marked “Clean and Green Challenge Winners” to the Sponsor. Requests for identification of the winners must be received no later than ninety (90) days from the Challenge End Date (residents of Vermont and Washington need not include return postage).

8. NOTICE:

The Sponsor reserves the right to prosecute and seek damages against any individual who attempts to deliberately undermine the proper operation of the Challenge in violation of these Official Rules and/or criminal and/or civil law.
